the Ridgebury Presbyterian Church of Wawayanda, NY,<br \/>\nin the Presbytery of Hudson River, may keep its property as it<br \/>\nseparates from the PC(USA).&nbsp; The church is happy, the presbytery<br \/>\nis not, the presbytery is deciding whether to appeal.<\/p>\n<p>The judge based his decision on the fact that the church has held deed<br \/>\nto its property since 1792, before the 1983 trust clause and even<br \/>\nbefore it joined a presbytery in 1817.&nbsp; One news article said the<br \/>\njudge relied heavily on a 1984 decision by a state Court of Appeals<br \/>\ndecision that said a <span class=\"text\">Presbyterian church in<br \/>\nSchenectady did not have an implied trust with its denomination.&nbsp;<br \/>\nIn fact, the judge got into theological discussion concerning the level<br \/>\nof &#8220;obedience&#8221; to the hierarchy of a church in a full hierarchical<br \/>\nsystem, like the Episcapalians, versus a church in a presbyterian<br \/>\nsystem.&nbsp; To this the presbytery lawyer said the judge overstepped<br \/>\nhis bounds.<\/p>\n<p>So far two news articles have reported on this, one from The <a href=\"http:\/\/www.recordonline.com\/apps\/pbcs.dll\/article?AID=\/20060826\/NEWS\/608260327\" target=\"_blank\">Times Herald-Record<\/a> and one from <a href=\"http:\/\/www.thejournalnews.com\/apps\/pbcs.dll\/article?AID=\/20060825\/NEWS02\/608250327\/1028\/NEWS12\" target=\"_blank\">The Journal News<\/a>.&nbsp; The first is more matter-of-fact, the second is a bit more sensational but has the theological info in it.<\/p>\n<p>The Hudson River Presbytery has announced the news on their <a href=\"http:\/\/www.hudrivpres.org\/\" target=\"_blank\">home page<\/a> and has a link to the <a href=\"http:\/\/www.hudrivpres.org\/03.2006%20DSpierling\/Court%20decision.pdf\" target=\"_blank\">court decision<\/a>.<br \/>\n<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a decision by a New York Ninth Judicial District Supreme Court Justice yesterday (August 25)&nbsp;
